Simio & Jones, LLP maintains an active commercial litigation practice. We successfully represent a broad spectrum of clients in civil litigation before state and federal courts, administrative agencies and in alternative dispute resolution forums such as arbitration and mediation.

Our attorneys represent the small business owner in routine contract disputes, oppressed minority shareholder and collection disputes as well as large corporations in some of their most complex disputes involving franchising, employment contracts/restrictive covenants, wrongful termination, tortious interference and fraud.

We look at litigation as a business issue and analyze disputes with a true business sense.  We counsel our clients on how to avoid litigation if possible, and if unavoidable,  we advise our clients on how to deal with it in the most cost-effective manner.  The Firm's attorneys are as adept at negotiating beneficial resolutions to commercial disputes without resorting to litigation, as they are in vindicating a client's rights in a court of law through the full use of the adversarial process.

We listen to our clients' needs and work with you each step of the way from initial contact through dispute resolution.  Our litigators put all of their skills and experience to work for our clients to help achieve the best possible business outcome.

Among the types of litigation the Firm typically handles are:

  • Disputes involving breach of contract, breach of warranty, and commercial torts of all kinds (e.g. fraud, negligent misrepresentation, and unfair competition);

  • Franchise disputes;

  • Collection matters;

  • Corporation, shareholder and partnership disputes;

  • Employment related litigation;

  • Appellate practice;

  • Small business litigation; and

  • Actions prosecuting or defending temporary restraining orders and preliminary and permanent injunctions.

In all instances, the Firm's attorneys are there for our clients and work diligently with you to establish the objective of the representation and thereafter, to develop and employ the legal strategy best suited for achieving that objective.
